Your privacy is critically important to us. This privacy policy explains Beacon Athlete Tracking Inc.’s (“Beacon”) policies regarding data collection and data usage through your use of, access to and registration on the website www.beaconathletetracking.com, any Apps and other related Beacon platforms, products, including the BAT GPS Tracking Device (the “Device”), and services (collectively, “Beacon Services”). At Beacon, we have a few fundamental principles:

Summary

  • We receive and may collect technical information, personally identifying information, and Tracking Information (defined as information regarding the Device user’s performance and logistics, including but not limited to speed, bearing, time stamp and position).
  • Our cloud services collect and store information about you for the purposes of providing live tracking and related operations.
  • We collect information about you to be used in our operations during a live tracking event (e.g., race day). During the event periodic updates about your position, speed, and other relevant data is collected, processed, and transmitted to fans following your progress.
  • We store information about you including your name, email address, contact phone number, user ID, OpenID, and other optional information. While “live tracking” we will also store information provided by our tracker device including your location, time stamp, speed, bearing, device ID, and battery level.
  • We will store this information for at least two years.
  • We own any and all data collected by our web site, apps, in-person entry, and tracking information forever.
  • We use this information to provide our live tracking service and related activities. We may, at times, provide processed anonymous statistical data to 3rd parties that will not identify you.
  • At a minimum, we are bound and compliant to the rules and regulations provided by the United States and Delaware.
  • You have the right to update or remove your user account information at will.
  • We may make updates to this privacy policy as appropriate.

Please take time to read this policy carefully as it specifies which rights you have and how to exercise them. This privacy policy does not apply to the privacy practices of third parties whose links may appear on or through Beacon Services. We are not responsible for the content or privacy practices of third parties or other Users. We recommend that you exercise caution before you voluntarily disclose personally identifiable information to other users, on publically accessible or displayable parts of the Service, or through third-party links on third-party websites or platforms.

I. OUR CLOUD SERVICE:

Through Beacon Services, and will collect and share Tracking Information with the intent that people who wish to be tracked (e.g., an “athlete”) may share this information through certain Beacon Services, to others who wish to follow (e.g., teammates, family, friends; also called “fans”). Tracking Information, sent from Devices to our cloud system is provided to fans with minimum possible delay, to convey athlete position reporting as accurately as possible. Beacon stores Tracking Information so that athletes can review it at a later date.


II. COLLECTION AND USE OF INFORMATION:

We collect and store all information provided to us by you through Beacon Services. Some of this information may be personally-identifying information, such as your name, email address, phone number, user ID, and OpenID, and in the event of an athlete, the name and other details of the primary fan associated with your account. Additionally, when actively using a Device, we will store Tracking Information collected by the Device.


a) Email Addresses

We do not and will not send spam, sell or rent your email address or any social media login account information to third parties. Further, we will not email you with marketing or promotional emails unless you have opted-in to our marketing distribution list(s). We do not disclose, sell, share, trade or give away your personal information to third parties, except as needed for completing payment and billing transactions through the services of payment processing vendors, if applicable, and for providing Tracking Information to fans.

b) Logging Statistics

Like most website operators, our servers automatically collect certain types of non-personally-identifying, technical information, such as the browser type, language preference, referring site, and the date and time of each visitor request. We use this information to better understand how our visitors use Beacon Services, and to maintain, optimize and improve Beacon Services.

c) IP Addresses

Internet Protocol addresses indicate the location of a user’s computers or mobile device on a network connected to the Internet. Providing Beacon Services to you may result in the logging of IP addresses for systems administration and troubleshooting purposes. We do not log IP addresses to track your session, nor do we link IP addresses to anything personally identifiable.

d) Cookies

Your use of Beacon Services may result in the assignment and storage of session cookies to recognize your access privileges. A cookie is a text file that is placed on the hard disk of your computer or mobile device by a server. Session cookies expire when you end your session and close your browser interface. Cookies cannot be used to run programs or deliver viruses to your computer or mobile device. Cookies are uniquely assigned to you, and can only be read by a server in the domain that issued the cookie to you. We use cookies to help us identify and track visitors, their usage of and preferences on Our website. Visitors who do not wish to have cookies placed on their computers or mobile devices should set their browsers to “Refuse Cookies” before using Our Services, with the drawback that certain features of Our Services may not function properly without the aid of cookies.

You have the right to gain access to, correct and/or remove all personal user account information we store about you, free of charge. In order to exercise your rights, you may use our the Beacon website or App to make these changes. III. DATA STORAGE DURATION:

Your user account information and Tracking Information is stored in our cloud service for at least two (2) years.


IV. DATA OWNERSHIP:

You grant Beacon an unconditional, world-wide, royalty-free license to use in perpetuity and in accordance with the Terms of Service and this privacy policy, any data provided by you to us, in person (e.g., at an event kiosk), or through Beacon Services.. Your account data may be removed from our systems at your request.


V. PROTECTION OF CERTAIN PERSONALLY IDENTIFYING INFORMATION:

We use the information you provide us to associate your user account with any request for live tracking indicating that you wish to be tracked. For example: if you have rented a Device for a race day, we may use your account information to display details about you on our website tracker so that fans may follow your progress. We also use your account information so other users may discover and request to follow you. We will sometimes provide statistical information (trends, numbers, etc.) generated from data you provide us, to third parties. This information will be scrubbed of any personally identifying information to protect your identification.

Beacon takes all measures reasonably necessary to protect against the unauthorized access, use, alteration or destruction of potentially personally identifying and personally identifying information. To prevent unauthorized access, safeguard data accuracy, and maintain the appropriate use of information, we have put in place appropriate physical, technical, and administrative procedures to protect the personal information data you submit. We make every effort to ensure the integrity and security of our network and systems. However, since the Internet is not 100% secure and as new technology evolves and emerges, we cannot guarantee that our security measures will prevent third-party interferences from illegally obtaining or tampering with your personal information.

We encourage you to help us by also taking precautions to protect your personal data when you use the Services. Change your account password often, using a combination of letters, numbers, and characters, and make sure you use a secure connection.

Please note that we may provide access to your personal data in order to comply with law enforcement proceedings or court orders.


VI. TESTIMONIALS AND FEEDBACK:

We may display testimonials, request for support and feedback (together “Feedback”) from users of Beacon Services, but we will seek your consent first. We reserve the right to publish it (stripped of all personally identifying information, of course) in order to help us clarify or respond to your request or to help us support other Users. Feedback may also be displayed on our website and/or any print media that we issue to promote our services. It will contain your words and name. You may request to have Feedback removed by contacting us, and you understand that the removal of such Feedback is at the discretion of Beacon.


VII. THIRD PARTY LINKS:

We may include links to other websites whose privacy practices may differ from ours. If you submit personal information to any of those sites, your information is governed by their privacy policies. We encourage you to carefully read the privacy policy of any website you visit.


VIII. SOCIAL MEDIA WIDGETS:

Beacon Services may contain integrated social media features, such as the Twitter "tweet" button. These features may collect certain technical data from you to enable the feature to function properly. Social media features and Widgets are either hosted by a third party or hosted directly on Beacon Services. Your interactions with these features are governed by the privacy policy of the company providing it.


IX. INFORMATION FROM THIRD PARTY SERVICES:

Beacon may obtain information from third party services, which we use in combination information we collect through Beacon Services. For example, we may have access to data from a third party timing company during an ongoing race. We may also, with your permission, connect to social media services such as Facebook or Twitter. Any access that we may have to information from a third party service is in accordance with the authorization procedures determined by that service. You agree and understand that in order for Beacon Services to operate accurately, we must partner with certain third party services, and you authorize our access to, and storage and use of certain of your information that may be available through such third party services in accordance with this privacy policy and the privacy settings you choose for your profiles on any third party services we may use. You should check your privacy settings on these third party services to understand and change the information sent to us through these services.


X. PRIVACY OF MINORS:

We understand that minors (those who are 13 years old or under) may use Beacon Services from time to time. Beacon requires any user who qualifies as a minor to provide parental consent to use, register and access Beacon Services. Beacon does not knowingly solicit or collect personal information from minors without parental consent, and we will not knowingly link to any third-party website or platform that solicits or collects personal information from minors without parental consent. XI. Revisions:
